Terms of Service

1. Acceptance of terms

By using nycnannycare.com or booking a nanny or babysitter through NYC Nanny Care ("we", "us", "our"), you agree to these Terms of Service. If you do not agree, please do not use our website or services.

2. Our service

NYC Nanny Care is a nanny and babysitter placement service. We match families with independent caregivers in Manhattan, Brooklyn, and surrounding areas. We are not the direct employer of the nannies and babysitters we place, and each engagement is between the family and the caregiver, facilitated by us.

3. Background checks and vetting

We conduct background checks, reference checks, and CPR/First Aid certification verification on caregivers before placement, as described on our website. While we take reasonable care in vetting every caregiver we place, we cannot guarantee the conduct of any individual, and families are encouraged to conduct their own interviews and use their own judgment before and during any engagement.

4. Bookings, fees, and payment

Bookings are confirmed once a deposit is paid via our secure Stripe checkout. The remaining balance is due on the day of service unless otherwise agreed in writing. Full pricing is available on our website and may be updated from time to time; the price shown at the time of booking applies to that booking.

5. Cancellations and refunds

Cancellations are governed by our Refund & Cancellation Policy, which forms part of these Terms.

6. Your responsibilities

• Provide accurate information about your household, children, and care needs at the time of booking
• Ensure your home is reasonably safe for the caregiver and children in their care
• Treat caregivers placed by us with respect and in accordance with applicable labor laws
• Notify us promptly of any concerns about a placement

7. Limitation of liability

To the fullest extent permitted by law, NYC Nanny Care's liability for any claim arising from our placement service is limited to the fees paid for the booking in question. We are not liable for indirect, incidental, or consequential damages. Nothing in these Terms limits liability that cannot be excluded under applicable law.

8. Website use

You agree not to misuse our website, including attempting to gain unauthorized access to our systems, scraping content without permission, or using the site for any unlawful purpose.

9. Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in New York County, New York.

10. Changes to these terms

We may update these Terms from time to time. Continued use of our website or services after changes take effect constitutes acceptance of the revised Terms.
